General conditions of sale

Definition :

The general conditions of sale are proposed by the individual company ti-zef, registered in the trades directory under the number SIRET: 93083397500012, code APE 3299Z, whose head office is located at: 18 rue de Kerglos 29820 BOHARS France. Persons wishing to make a purchase via the website of the individual company ti-zef are invited to read these general conditions of sale.

These general terms and conditions of sale are applicable exclusively to the articles distributed and offered for sale at distance through the site : www.ti-zef.com

Article 1 : General 

The seller reserves the right to modify the general conditions of sale published on the site, at any time. When ordering, the applicable general conditions of sale will be the latest conditions published on the site. The legal information concerning the host and the publisher of the site, the collection and processing of personal data are proposed in the legal notice of the site.

The site offers online sale of metallic statuettes ti-zef, unique models, numbered and signed. During the manufacture, the statuettes that may present certain similarities, will all have a real singularity  and  sometimes  slight  defects  inherent  in their manufacture, after passing through the hands of the artist.

The weight of the statuettes can vary from 1Kg to 1,5Kg approximately, depending on the models. The average size is 33cm high, but can reach 45cm depending on the accessory chosen. The diameter of the statuette is between 12cm and 15cm. The company would not be held responsible if the object fell on the customer’s premises, injuring a person or degrading furniture or floor covering.

When purchasing a product, the customer acknowledges having read and accepted these GTC.  He will tick the box, “I acknowledge having read and accepted the terms and conditions of the Site”. The customer therefore expressly accepts the general terms and conditions of sale.

The customer authorizes the seller to use an automatic registration system and waives contesting it in case of dispute. The site’s privacy policy specifies all this information.

Section 2 : Customer Information 

To place an order online, the customer, over 18 years of age, must have a credit card. The company cannot be held responsible for problems related to the internet network, service disruption, connection problems, presence of a computer virus.

The personal information provided by the customer will be kept by the company to justify the transaction to administrative services such as taxes. (Article L.123-22 of the commercial code). These archived data will not be passed on to other entities for commercial prospecting purposes.

Article 3 : How to place an order ?

The statuettes are offered within the limits of available stocks.

The photographs of the products are only indicative and may differ from the original object, especially in terms of colors.

In order to place an order, the customer will choose the product from the site’s shop and add it to his cart. The contents of the shopping cart can be changed at any time. The customer can then validate his order by accessing his cart, clicking on the button provided for this purpose. The customer will be redirected to a summary page with all transaction information, as well as additional costs related to shipping and packaging.

To place an order, the customer must tick the box for acceptance of these GTC. It will then be redirected to an order form. When issuing the order form, the customer must provide the seller with his name, first name, postal address and e-mail address to arrange delivery. The customer will be delivered  to his home, in colissimo, by  La Poste. A tracking  number of the carriere will be communicated.

The product reserved by the customer will remain visible on the site, but will no longer be available for purchase. Once the form is completed, the customer will make his payment online using the payment method presented. The customer will then receive an order confirmation email reminding them of the content of the order and its price. After forty-eight hours, if the financial transaction has not taken place, the reservation and order will be cancelled and the product will be put back on sale.

Article 4 : Payment terms

The prices of the products are net, in euros, without application of VAT (article 293B of the CGI). The price of the product will be that indicated on the website (sales price TTC of the product as well as the price, related to the port and packaging)

The bank details, card number, will be used to finalize the online purchase via the STRIPE platform. Upon receipt of payment, approximately 10 days after purchase, the invoice will be sent to the buyer by email. All invoices will be retained by the company and serve as evidence of the business transaction between customers and the company.

The delivery costs, including the packing costs, will be indicated to the customer before payment.

Article 5 : Delivery Terms

The company ti-zef will ensure the shipment of the product by colissimo (La Poste). The customer will be informed by email, that his package has been delivered to the carrier.

In accordance with the provisions of article L.121-19 of the French Consumer Code, a duplicate invoice will accompany the product shipped.

An unsuccessful delivery (wrong address, absence of the customer…) could cause additional delays in the delivery of the product. The company will not be held responsible for this delivery problem due to an address error.

The customer who receives a package has legally, a period of 15 minutes to open, unpack, and check the product. If the delivery person does not want to wait until unpacking is complete, write in full: “the delivery person did not wish to stay” and have the delivery person sign. This document can be used as evidence in the event of a problem.

For any product damaged during transport and not reported, no claim will be admissible (article L.133-3 of the commercial code). As soon as the delivery note is signed, the verification of the condition of the product is considered to be completed. Delivery times will be about 15 days.

Article 6 : Returns and refunds

6.1 – What is your withdrawal period for a distance purchase?

You have 14 days from the day after delivery of the product to exercise your right of withdrawal on your purchase. Article L.221-18 of the Consumer Code. If the deadline expires on a Saturday, Sunday or public holiday, it is extended until the following working day.

Exclusion: Products made on demand and customized. The customer will receive a photo of the product before the transaction is completed. These products will not be returned or exchanged.

6.2 – How to exercise your right of withdrawal?

Before the expiry of the withdrawal period, you must send us a duly completed withdrawal form to the following email address: contact@ti-zef.com

From the date of sending the email, expressing your desire to exercise your right of withdrawal, according to article L.221-23 of the consumer code, you have a period of fourteen days to return the statuette to the following address:

As specified in article L.221-23 of the Consumer Code, “the consumer bears the direct costs of returning goods”. For this transaction, the return costs will be borne by the customer.

6.3 – Time limits and method of reimbursement:

The costs of return, when a return, will be borne by the customer. The return of the goods to the seller will be made at the latest within 14 days after sending your request for withdrawal.

The refund of the sum committed by the customer will be made by bank transfer from the bank account of the company ti-zef to the bank account of the customer. To finalize the refund, the customer will therefore be required to provide the company ti-zef with his bank details, by email, at the following address: »contact@ti-zef.com ».

Article 7 : Litigation

In the event of a dispute between the customer and the company, in accordance with article L.612-1 of the Consumer Code, the customer may contact a mediator before bringing legal action. The mediator can only be contacted after an attempt to settle the dispute with the company.
